* If owner is acting as contractor, they must sign the Owner Builder Disclosure Affidavit (located in Supplemental Forms) and must be able to complete all the work themselves, or hire licensed contractors i.e. (electrical, plumbing, hvac, roof). This is needed with the application.

      Florida Department of Environmental Protection (FDEP) – NPDES Construction Generic Permit (CGP)

      You must prepare and submit a SWPPP and obtain permit coverage if your project:

      • Disturbs one acre or more, OR
      • Disturbs less than one acre but is part of a larger common plan of development that will ultimately disturb one acre or more,
         AND
      • Discharges stormwater to state surface waters or a municipal separate storm sewer system (MS4).
    • Town of Fort Myers Beach – Local Stormwater & Erosion Control Requirements

      1. SWPPP Encouraged for Small Projects (<1 Acre)
        • Even for smaller projects—such as pool installations, dewatering, or minor site work—submission of a SWPPP is strongly encouraged, especially if located near the Town’s stormwater infrastructure or natural waterways.
        • Standard Best Management Practices (BMPs) are expected regardless of project size, including silt fences, turbidity barriers, and inlet protection.
      2. Impervious Surface Retention Requirements
        Per Chapter 6, Article I of the Town Code:
        • Projects that add more than 500 sq. ft. of impervious surface (e.g., driveways, patios, rooftops, or fill) must be designed to retain rainfall on-site:
          • 1 inch for interior lots
          • 1.6 inches for waterfront lots
      3. Stormwater Utility Fee and Impervious Surface Mapping
        • All projects must map any new impervious areas to ensure accurate stormwater utility billing.
        • Incorporating BMPs such as rain gardens or cisterns may help reduce associated fees.
    • Why Submit a SWPPP, Even for Smaller Projects?

      Even if your project disturbs less than one acre, you are still required to address local stormwater management and erosion control standards. Submitting a SWPPP is a proactive way to:

      • Protect nearby canals, waterways, and beaches from pollutants
      • Ensure full compliance with Town Code
      • Support accurate utility fee assessments based on impervious surface area
