The Town of Fort Myers Beach has no repetitive loss or cumulative substantial damage language in its flood ordinance. Therefore, for properties impacted by Ian, Helene, or Milton, the Beach is following the procedures below:
1. Properties with Issued or Completed Permits from Hurricane Ian:
- Issued Permits from Ian:
- Properties with issued permits (in-progress) for Hurricane Ian repairs need to file for a permit revision if the structure sustained new damage.
- Specify in the revision application that the additional repairs are for damage from Hurricane Helene or Milton. Provide contractor estimates, itemized materials, and/or labor. Any previous repairs permitted for Hurricane Ian will not be included in the 50% rule calculations for Helene/Milton.
- The appraised value for the building will be based on the structure's replacement cost or actual cash value before Hurricane Helene/Milton.
- Completed Permits from Ian:
- Properties with permits completed from Hurricane Ian must file for a new permit if the structure sustained new damage.
- Specify in the revision application that the additional repairs are for damage from Hurricane Helene or Milton. Provide contractor estimates, itemized materials, and/or labor. Any previous repairs permitted for Hurricane Ian will not be included in the 50% rule calculations for Helene/Milton.
- The appraised value for the building will be based on the structure's 2024 replacement cost or actual cash value before Hurricane Helene/Milton.
2. Properties with No Permitted Work Post-Hurricane Ian:
- Unless the property owner has copies of damage assessments or estimates from a licensed contractor for each storm event, FMB must use a cumulative approach to determine substantial damage.
- In this case, substantial damage will be the cost of restoring the building to its before-damaged condition prior to Hurricane Ian.
- The appraised value for the building will be based on the structure's 2022 replacement cost or actual cash value before Hurricane Ian.
